Welcome to Red Mare Mercantile. The terms "we," "us," and "our" refer to Red Mare Mercantile. We operate this store and website, including all related information, content, tools, products, and services (the "Services"). Red Mare Mercantile is powered by Shopify.
These Terms of Service ("Terms"), together with our Privacy Policy, Refund Policy, and Shipping Policy, describe your rights and responsibilities when you use the Services. By visiting our site or purchasing from us, you agree to these Terms. If you do not agree, please do not use the Services.
Section 1: About Red Mare Mercantile
Red Mare Mercantile is a print-on-demand shop designed by and for the horse community, with a special focus on endurance and trail riders, the equestrian LGBTQ+ community, and mustang lovers and advocates. Our products are made to order by third-party print-on-demand fulfillment partners.
Section 2: Access and Accounts
By agreeing to these Terms, you confirm that you are at least the age of majority in your state or province of residence, or that you are using the Services with the consent of a parent or guardian.
You agree that all information you provide to us, including your email, billing, payment, and shipping information, is accurate, current, and complete. You are responsible for keeping your account credentials secure and for all activity under your account.
Section 3: Our Products
Because our products are printed on demand:
- Items are not produced until an order is placed.
- Slight variations in color, print placement, or sizing may occur between print runs. This is normal for print-on-demand products and is not considered a defect.
- Product images are representations. Colors and details may look different on your screen depending on your device and settings.
We may change product descriptions, discontinue products, or limit quantities at any time.
Section 4: Orders
When you place an order, you are making an offer to purchase. We may accept or decline any order at our discretion, including in cases of suspected fraud or pricing errors. If we cancel an order after payment, we will issue a full refund.
Orders are submitted to production quickly, so we may not be able to change or cancel an order once it has been placed. Please review your order carefully before submitting it.
Purchases are for your own personal or household use and not for commercial resale.
Section 5: Prices and Billing
All prices are in U.S. dollars and may change without notice. The price you pay is the price in effect when you place your order, as shown in your order confirmation. Unless stated otherwise, prices do not include taxes, shipping, or any customs or import charges.
Payment is processed securely through our payment providers. Red Mare Mercantile does not store your full payment card information. You confirm that you are authorized to use the payment method you provide.
Section 6: Shipping and Delivery
We submit orders to production daily, and most orders ship within 2–4 business days. Delivery times after shipping are estimates and are not guaranteed. We are not responsible for delays caused by carriers, customs, weather, or other events outside our control. See our Shipping Policy for details.
Please double-check your shipping address before completing checkout. We are not responsible for orders shipped to an incorrect address provided by the customer, or for packages lost or stolen after the carrier confirms delivery.
Section 7: Returns, Exchanges, and Refunds
We offer a 30-Day Happiness Guarantee. If you are not happy with your order for any reason, contact us within 30 days of delivery and we will send you a replacement or accept a return for a refund. This includes worn or washed items, sale items, and size or fit issues.
Custom and personalized items, such as custom mustang brand shirts, names, or mileage, are covered only if they arrive damaged, defective, misprinted, or different from what you ordered.

Section 8: Intellectual Property
All designs, artwork, graphics, logos, text, and other content on the Services belong to Red Mare Mercantile or its licensors and are protected by copyright, trademark, and other laws. You may not copy, reproduce, modify, distribute, or use any of our designs for commercial purposes without our written permission.
Buying a product gives you the right to use that physical item for personal use. It does not transfer any intellectual property rights in the design.
Section 9: Inclusive Community Standards
Red Mare Mercantile is committed to being a welcoming space for all horse lovers, including the equestrian LGBTQ+ community, mustang advocates, endurance and trail riders, and riders of every background, ability, and discipline.
We may refuse service to anyone who uses our site, communications, or community spaces in ways that are harassing, discriminatory, or harmful to others, including hate speech or targeting people based on race, gender identity, sexual orientation, religion, disability, or national origin.
Section 10: Third-Party Tools and Links
The Services may include tools, content, or links provided by third parties. We do not control and are not responsible for third-party websites, products, or services. Your use of them is at your own risk and subject to their own terms and policies.
Section 11: Relationship with Shopify
Red Mare Mercantile is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Red Mare Mercantile. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Red Mare Mercantile, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Red Mare Mercantile.
Section 12: Privacy
Personal information we collect is handled according to our Privacy Policy. Because our store is hosted by Shopify, certain information is also processed by Shopify according to Shopify's Privacy Policy.
Section 13: Feedback and Reviews
If you send us ideas, suggestions, reviews, or other feedback, you grant us permission to use, reproduce, and share that feedback for any purpose, including promoting our products, without compensation to you. You agree that your feedback will not violate anyone's rights or contain unlawful, abusive, or misleading content. We may remove any feedback we find objectionable.
Section 14: Errors and Inaccuracies
Information on our site may occasionally contain errors in product descriptions, pricing, promotions, shipping times, or availability. We may correct errors, update information, or cancel orders affected by an error at any time, including after an order has been placed.
Section 15: Prohibited Uses
You may use the Services for lawful purposes only. You may not use the Services to break any law; infringe our or anyone else's intellectual property; harass, abuse, or discriminate against others; submit false or misleading information; upload viruses or malicious code; collect other people's personal information; spam, scrape, or crawl the site; or interfere with the site's security or operation. We may suspend or terminate access for anyone who violates these Terms.
Section 16: Disclaimer of Warranties
Except as expressly stated by Red Mare Mercantile, including in our 30-Day Happiness Guarantee and Refund Policy, the Services and all products are provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not guarantee that the Services will be uninterrupted, timely, secure, or error-free. Some jurisdictions do not allow certain warranty disclaimers, so parts of this section may not apply to you.
Section 17: Limitation of Liability
To the fullest extent permitted by law, Red Mare Mercantile, its owners, partners, and service providers, and Shopify and its affiliates, will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services or any products purchased through them. Our total liability for any claim will not exceed the amount you paid for the order in question.
Section 18: Indemnification
You agree to indemnify and hold harmless Red Mare Mercantile, Shopify, and their affiliates, partners, and service providers from any claims, damages, or costs, including reasonable attorneys' fees, arising from your breach of these Terms, your violation of any law, or your violation of the rights of a third party.
Section 19: Severability, Waiver, and Entire Agreement
If any part of these Terms is found unenforceable, that part will be enforced to the fullest extent permitted, and the rest of these Terms will remain in effect. Our failure to enforce any part of these Terms is not a waiver of our right to do so later.
These Terms, together with the policies referenced above, are the entire agreement between you and Red Mare Mercantile regarding the Services and replace any earlier versions.
Section 20: Assignment
You may not transfer your rights or obligations under these Terms without our written consent. We may transfer our rights and obligations under these Terms without notice to you.
Section 21: Governing Law
These Terms are governed by the laws of the State of Oregon, United States, without regard to its conflict-of-law rules. You and Red Mare Mercantile agree to the jurisdiction of the state and federal courts located in Oregon.
Section 22: Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated date. Your continued use of the Services after changes are posted means you accept the updated Terms.
